1. Acceptance of Terms
Welcome to ClinkMe! These Terms of Service ("Terms") govern your access to and use of the ClinkMe mobile application, website, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, you may not access or use the Service.
2. About ClinkMe
ClinkMe is a digital gifting platform that allows users to send and receive food, drinks, and other items from local restaurants and venues. ClinkMe acts as a payment facilitator and technology platform connecting gift senders, recipients, and participating merchants.
3. Eligibility
3.1 Age Requirement
You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old.
3.2 Geographic Restrictions
The Service is currently available only in the United States. We reserve the right to expand or limit geographic availability at our discretion.
3.3 Account Capacity
You represent that you have the legal capacity to enter into a binding contract and are not barred from using the Service under applicable law.
4. Account Registration and Security
To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information and maintain the security of your account credentials.
You are responsible for all activities that occur under your account. We reserve the right to suspend or terminate your account at any time for violation of these Terms.
6. Gift Transactions
6.1 Sending Gifts
When you send a gift through ClinkMe, you authorize us to charge your payment method for the full gift amount plus any applicable fees. The transaction is final once processed.
6.2 Gift Expiration
Gifts expire according to the expiration date specified at the time of purchase (typically 30-90 days). Expired gifts have no cash value and cannot be refunded or redeemed.
6.3 Gift Redemption
Gifts must be redeemed at the specified participating venue during their hours of operation. You must present your redemption code or QR code to complete redemption.
7. Payment Terms
Payment processing is handled by our third-party payment processor, Stripe. All prices are in U.S. Dollars and include any applicable service fees, which will be clearly disclosed before purchase.
You authorize us to store your payment method information for future transactions. You represent that you are authorized to use the payment method you provide.
8. Refunds and Cancellations
All gift purchases are final and non-refundable except in the following circumstances:
- Technical error resulting in duplicate charges
- Merchant closure or permanent unavailability before gift redemption
- Fraudulent transaction not authorized by account holder
- As otherwise required by applicable law
To request a refund under these circumstances, contact our support team at support@clinkme.app within 30 days of the transaction.
9. Merchant Relationships
Participating venues are independent third parties. ClinkMe does not own, operate, or control participating merchants. Merchants are solely responsible for the quality, preparation, and delivery of their goods and services.
ClinkMe is not responsible for merchant service quality, customer service, or policies. If you experience issues with a merchant, contact them directly first, then contact our support team if the issue remains unresolved.
12. Disclaimers and Limitations of Liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.
To the maximum extent permitted by law, ClinkMe and its officers, directors, employees, and agents shall not be liable for indirect, incidental, special, consequential, or punitive damages, or damages exceeding the amount paid by you in the 12 months preceding the claim.
14. Dispute Resolution
Before filing a claim, you agree to contact us at legal@clinkme.app to attempt informal resolution.
If informal resolution fails, disputes will be resolved through binding arbitration conducted by the American Arbitration Association (AAA) under the AAA's Consumer Arbitration Rules, rather than in court.
CLASS ACTION WAIVER: You agree that disputes will be resolved on an individual basis only. No class action, class arbitration, or representative action is permitted.
16. Privacy
Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information. By using the Service, you agree to our Privacy Policy.
